The American Law Institute is the leading independent organization in the United States producing scholarly work to clarify, modernize, and otherwise improve the law. The Institute (made up of 4000 lawyers, judges, and law professors of the highest qualifications) drafts, discusses, revises, and publishes Restatements of the Law, model statutes, and principles of law that are enormously influential in the courts and legislatures, as well as, in legal scholarship and education.
In addition to codifications and studies, the American Law Institute primarily examines chosen core legal subjects with two types of publications. Restatements of the Law, containing clear formulations of common law and its statutory elements or variations, reflect the law as it presently stands or might plausibly be stated by a court. Principles of the Law analyze legal areas thought to be in need of reform; Principles aim to express the law as it should be. Like Restatements, Principles publications use the familiar black-letter statements of recommended legal rules, supported by Comments, Illustrations, and Reporter's Notes.
Content Highlights:
The full text of Restatement of the Law Third-The Law Governing Lawyers, which covers the common law applicable to the legal profession: regulation of the profession; the client-lawyer relationship, including the financial and property relationship; lawyer civil liability; confidential client information; representing clients, especially in litigation; and conflict of interest. A document is a section, general materials, or note. Section documents contain the black letter Restatement, Illustrations, Reporter's Notes, and Commentaries. Additionally, if a Restatement section has been updated with subsequent case citations, a "Link to Case Citations" link will appear at the top of the document. Taking this link will redirect the user further down in the document to a chronological list of cases that have cited the Restatement section.
